General Terms and Conditions
ARTICLE 1: OBJECT
The purpose of these general conditions of sale (the “General Conditions of Sale”) is, on the one hand, to inform any customer of the conditions and terms under which ROSALY (the “Seller”) carries out the sale and the delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties arising from any purchase made on the website www.rosalycosmetics.ch (the “Site”) by a customer (the “Buyer”) .
For the purposes of the General Conditions of Sale, the Buyer and the Seller are collectively referred to hereinafter as the “Parties”.
These General Conditions of Sale apply, without restriction or reservation, to all purchases made on the Site. Consequently, any purchase on the Site automatically entails acceptance of all of the General Conditions of Sale of which the Buyer declares having read prior to his order.
The products are offered for sale and delivery on Swiss territory only.
The Seller reserves the right to modify these General Conditions of Sale at its sole discretion. However, the general conditions of sale applicable to an order placed by a Buyer on the Site are those accepted by the Buyer at the time of placing an order.
ARTICLE 2 - DELIVERY AND RECEIPT
After order confirmation and payment validation, the products will be delivered to the delivery address indicated by the Buyer during the order process.
Upon delivery, and in the event of absence, the Buyer or the recipient of the order receives a delivery notice, allowing him to collect the ordered products from the post office indicated in the delivery notice, for a period of fifteen days. After this period or in the event of express refusal of the package, it is returned to the sender. For all practical purposes, it is specified that under no circumstances will the Seller reimburse the order made by the Buyer, this being final.
ARTICLE 3 – LOSS OR BROKENAGE OF PRODUCTS
The Seller therefore declines all responsibility in the event of excessive delivery time due to postal services, as well as in the event of loss of ordered products or postal service strikes. It is specified that the risks of transport are borne by the Buyer.
The Seller cannot therefore be held responsible in particular in the event of loss, sending to the wrong address or late delivery of a product, to the extent that the risks of the transport that the Buyer chooses rest on him.
ARTICLE 4 – INTELLECTUAL PROPERTY
All elements present on the Site, whether visual, textual or audio, are the exclusive property of the Seller, or of the holder of the intellectual property rights concerned, and are as such protected by the Intellectual Property Code and the copyright. It is, however, authorized to set up links to the Site if this is done in a fair manner and this does not in any way harm the reputation of the Seller and/or the brand that it operates or benefits from its fame. However, it is prohibited to establish such a link so that it suggests a form of association if this does not exist. Furthermore, it is strictly prohibited to set up a link to the Site on a website that does not belong to you. We reserve the right to remove links or request removal of links without notice.
ARTICLE 5 – ABSENCE OF WITHDRAWAL GIVEN THE NATURE OF THE PRODUCTS
To the extent that the products on sale on the Site are not subject to sealing and that no secondary blister pack is used in the packaging for reasons of environmental preservation, the right of withdrawal referred to in article L. 221-18 of the Consumer Code cannot be exercised following an order for products on the Site in accordance with article L. 221-28 (5°) of the Consumer Code .
ARTICLE 6 - RISKS AND GUARANTEE
The Seller retains full ownership of the products sold online on the Site until full payment of the price, in principal, fees and taxes included.
Consequently, the transfer of risks on the products sold by the Seller takes place upon delivery of the products to the services of La Poste.
If the products sent do not conform to the Buyer's order or are defective, they will be replaced at the Seller's expense.
Any complaint must be made within 48 hours of receipt of your package; after this period the Seller cannot be held responsible for any anomalies. In the event of a problem, please send a complaint email specifying the subject to the following address: email@example.com.
ARTICLE 7 - PARTIAL NON-VALIDITY
If one or more stipulations of the General Conditions of Sale are declared null or inapplicable in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force and validity. scope.
